Lady Justice Arden, Lady Justice Rafferty and Lord Justice Kitchin upheld Mr Justice Mann's judgment in the Court of Appeal. In the Court of Appeal judgement, Lady Justice Arden said it was "wrong" to look at the sums awarded without remembering that "there were misuses of private information beyond our ability to know and count".
