No formal charges have been brought against him yet. He was charged with conspiring with Farook to commit crimes of terrorism, unlawful purchase of two assault rifles used in the shooting and defrauding immigration authorities by entering into a sham marriage with Farook's sister-in-law.
He is being held without bail at a detention centre in Riverside, California, the Washington Post reports, with his first hearing scheduled for 21 January. Mr Marquez is scheduled appear in court on Thursday afternoon, the US Department of Justice said.
"While there is currently no evidence that Mr Marquez participated in the December 2 attack or had advance knowledge of it, his prior purchase or firearms and ongoing failure to warn authorities about Farook's intent to commit mass murder had fatal consequences," US Attorney Eileen Decker said.
