He was also placed on the sex offenders' register at Aberdeen Sheriff Court. Sheriff Alexander Jessop said he felt "disgust" at the alarm caused. At Aberdeen Sheriff Court, he was placed on probation for two years and was also placed on the sex offenders' register.
Sheriff Jessop said Whyte deserved to be jailed, but feared this would not stop him reoffending because his behaviour would not be addressed.
Sheriff Jessop told him: "I can't help feeling disgust at the alarm and distress you must have caused.
"I have given the matter much consideration and have decided to place you on probation. This is the best way of securing against you re-offending.
"The joint sex offenders programme is a very demanding programme over 18 months. Probation is not an easy option."
