Elaine Motion, the senior solicitor with the Edinburgh law firm Balfour+Manson who represented the Scottish National party MP Joanna Cherry and the 75 other petitioners in the Scottish case, said the ruling upheld the “critical importance” of the sovereignty of parliament.
In a statement, Motion said: “The unanimous decision of the UK supreme court today, to cut down the prorogation, essentially reconfirms the position taken by the court of session. That means that the clock is rewound to 27 August and parliament is not suspended. It is as if the suspension never occurred.
“It is a huge vindication for the parliamentarians who led the way with the challenge in Scotland and an even more significant reinforcement of the critical importance of the rule of law and the sovereignty of parliament. Hopefully parliament can now get back to its essential work.”
This is the second major legal victory on Brexit for Motion and Aidan O’Neill QC, the advocate who led the Scottish case. She was the solicitor, working with O’Neill, for the eight Scottish parliamentarians who won the European court of justice case against the UK government last December which ruled the UK could unilaterally revoke article 50.
