An Irish teaching union has demanded greater legal protection for teachers who have been tasked with calculating exam grades after tests were cancelled. Fears that Irish teachers could face personal costs if school-leavers took legal action over predicted grades have been resolved, a union has said.
The Leaving Cert exam - Ireland's equivalent of A Levels - will not take place this summer due to the pandemic. Teachers were asked to calculate grades after the cancellation of the Leaving Cert, Ireland's equivalent of A Levels.
The government issued guidelines on how to estimate results, which includes a "State indemnity" for teachers. The Association of Secondary Teachers, Ireland (Asti) previously advised its 17,000 members not to estimate grades until legal liability was addressed.
But one union expressed fears teachers could still face personal costs if sued by students unhappy with their grades. But Asti has now said it has government assurances of "full indemnity".
'Unacceptable' The union has also revised its advice and is now encouraging teachers to take part in the grading process.
The Association of Secondary Teachers, Ireland (ASTI) has advised its 17,000 members not to co-operate with the government guidelines until there is a guarantee of "full indemnity" against legal costs. It follows discussions between the union and the Department of Education on Friday, organised after Asti objected to government guidelines on how school-leavers' performance should be assessed.
"Unfortunately, and upon legal advice, the indemnity that has been offered to teachers thus far falls short of what is required and could potentially lead to personal liabilities for costs," a statement from ASTI said. The guidelines included a "State indemnity" for teachers, but Asti said this did not go far enough to protect its members from personal liability in the event that a student unhappy with their results took legal action.
ASTI added the current position was "unacceptable" and advised its members "not to undertake any work on the process until this issue is resolved". However, following the talks on Friday, Asti said: "This strengthening of the indemnity will ensure that a teacher will not have to employ her/ his own legal team to defend herself/ himself and run the risk of incurring large irrecoverable costs and expenses."
However, a separate union - the Teachers' Union of Ireland (TUI) - welcomed the guidelines, saying there was "clear legal indemnity for teachers and schools".
The State indemnity is subject to conditions and will only apply when a teacher "has acted bona fide" meaning they have "made every reasonable effort" to calculate grades within government guidelines.
