Nurse struck off for patient sex

A nurse who was jailed for 16 months for having sex in a hospital toilet with a 16-year-old girl in his care has been struck off the nursing register. Oliver Balicao, 35, a married father from Bicester, Oxfordshire, was cleared of raping his patient at Oxford's John Radcliffe Hospital in March 2007. He admitted a charge of sexual activity with a child while in a position of trust and was jailed in January 2008. The Nursing and Midwifery Council (NMC) said he could not return to nursing. Balicao, who had worked for Oxford Radcliffe Hospitals NHS Trust since 2001, had unprotected sex with the patient, who had been admitted to A&E for an overdose and kept in overnight for observation. 'Fundamentally incompatible' When passing sentence in December 2007 Judge Anthony Hall told Balicao: "This was the grossest possible breach of trust. "By your actions you have brought a reputable hospital and a reputable profession into disrepute. You should be thoroughly ashamed of yourself." The NMC said it "wholly agreed" with the judge's assessment. A spokesman said Balicao had told the panel that his fitness to practise was "impaired" in light of the conviction. The spokesman said: "The panel is of the view that the registrant's behaviour was fundamentally incompatible to his continuing to be registered with the NMC. "The panel has come to the firm conclusion that a striking off order is the only appropriate sanction available." |
