Responsibility for the attack was claimed by the Real IRA. On Tuesday, a defence lawyer representing Brian Shivers stressed that no direct link had been drawn between his client and the mobile phone recording.
Colin Duffy from Lurgan has also been charged with the murders. Solicitor Niall Murphy said "At no stage was it mentioned in court that those remarks had anything to do with Mr Shivers."
Last month Brian Shivers became the second person to be charged in connection with the shooting.
In March, 41-year-old Colin Duffy from Lurgan was charged with murder, attempted murder and possession of a firearm.
The Real IRA has claimed responsibility for the attack.
