Scottish ministers have always been keen to stress that decisions about where prisoners are housed are taken independently by the Scottish Prison Service. The Scottish government has been all over the place on this issue this week.
But Nicola Sturgeon moved to draw a line in the sand when it came to the case of Isla Bryson - first by communicating her position to prison bosses, and then in the Scottish Parliament. On Wednesday, the justice secretary placed his trust in the Scottish Prison Service (SPS) to accommodate transgender prisoners on the basis of a risk assessment.
And now Justice Secretary Keith Brown is the one seeking to get on the front foot as further questions arise about further cases. Mr Brown told parliament: "The SPS is far more expert in assessing and dealing with that risk than any of us in this chamber".
There are important caveats and distinctions to be drawn between this row about prisons and the reforms passed by MSPs to make it easier to change sex in the eyes of the law. On Sunday, he decided that his permission will now be required before any transgender prisoner who has been violent towards women can be sent to a women's jail.
But in the eyes of the public, it may all be happening amid one big debate about self-identification. The presumption is against any such transfer while a policy review is completed.
With the government gearing up to defend its reform legislation in court, ministers will be desperate to look like they are on top of this issue. This change comes after the removal of the double rapist, Isla Bryson, from Cornton Vale women's prison on Thursday and Conservative demands for the proposed transfer of another violent transgender prisoner, Tiffany Scott to be stopped.
Campaigning by the Tories and others has been successful and forced the justice secretary to abandon his initial reluctance to intervene.

"We have very robust risk assessment processes, and a track record of keeping people safe, in often challenging circumstances.
"We have therefore paused the movement of all transgender individuals, until the review has been completed."

"Until the review is completed, any trans individuals, with a history of violence towards women, will only be admitted to the male estate, in segregation, when they first enter our care," they added.
