The weapon was later put on the arm of a chair in a computer room, but the argument had resumed. The court heard Scott Forbes approached his brother and that he thought he was going to be assaulted again. | |
'Considerable provocation' | |
He picked up the knife and struck the fatal blow which penetrated the right hand side of his brother's body. | |
Police arrived at the house and Forbes told them: "My brother is in the other room. I don't know if he is breathing." | |

Defence counsel David Burns QC said that before the fatal blow was struck the older brother had been smashing various items at his Forbes' home, including photo frames with the victim's children. | |
He said: "This was a familiar subject of argument between the brothers. | |
"He, the deceased, said to the accused that he could not have children. That was a familiar theme in the relationship between the brothers." | |
'Tragic case' | |
He explained: "This was a single blow with a knife introduced not by the accused, but by the deceased. It was struck under a very considerable degree of provocation." | |
Mr Burns said it was "a highly tragic case" but added that he would be asking the judge to accept that it was "at the lower end of the scale of culpability". | |
Temporary judge John Morris QC deferred sentence on Forbes for a background report and remanded him in custody. | |
