Man 'vowed to kill murder victim'
(about 3 hours later) | |
A man accused of murder claimed he was going to kill a neighbour he suspected was having an affair with the mother of his child, a court has heard.
Frances Muir said John Campbell, known as Jack, told her that one day he would go up to Robert Rose and "kill him".
Mr Campbell, 59, and Stephen Crummack, 50, deny murdering 54-year-old Mr Rose on the Orkney island of Sanday.
They have gone on trial at the High Court in Glasgow. The trial is due to last about three weeks.
They are alleged to have murdered Mr Rose, who had moved to Sanday from Rotherham, and concealed his body in sand dunes.
He [Mr Campbell] was angry with Bob. He said that one day he would go up to Bob and kill him Frances MuirWitness
His was found on the island last June after a major missing person inquiry.
Community nurse and midwife Mrs Muir told prosecutor Alex Prentice QC that she was asked by the island GP to visit Mr Campbell at his home at on the island on 1 April last year.
She said: "He had been feeling depressed and hadn't got much money and we were trying to help him.
"He was quite agitated about what had been going on because his partner Margaret Johnston had left him and taken their child.
"He said he thought she was seeing someone else and there were messages going back and forward between her and Bob Rose."
Make believe | |
Mr Prentice asked: "He believed Bob Rose and Margaret had some kind of relationship and were sending messages, is that correct?"
She replied: "Yes. He was depressed Margaret had gone and they were still communicating."
Mrs Muir was asked how Mr Campbell appeared and replied: "He was angry with Bob. He said that one day he would go up to Bob and kill him."
Mr Rose's daughter Katie gave evidence at the trial's start
Mr Rose's daughter Katie, 25, a beauty therapist who lives in Rotherham, said following the death of her mother her father decided to go and live on Sanday in March 2008.
Ms Rose said her father wanted a fresh start and sold her the family home in Rotherham.
She told the court that she and her two brothers went to Sanday and issued an appeal asking anyone who had any information to come forward after he vanished.
Ms Rose said that the next development was police calling to say her father's body had been found.
Mr Campbell and Mr Crummack are alleged to have held Mr Rose down on a bed, placed a pillow over his face and compressed it, repeatedly struck him on the head and body with their fists or other implements and robbed him of a quantity of money and murdered him.
They are also charged with attempting to defeat the ends of justice by concealing Mr Rose's body in a duvet, putting it his M-registration car and driving to sand dunes.
It is claimed that they buried Mr Rose's body in the dunes.
The prosecution alleges that the two accused then drove the car to a pier in an attempt to make people believe that Mr Rose had left the island on a ferry.
They are also alleged to have told various people on Sanday and police officers that Mr Rose had left the island and had asked them to look after his dog Patch.
It is also alleged that the pair burned a duvet and wallet belonging to Mr Rose and washed clothes they wore during the commission of the alleged murder.
The trial, before Lord Turnbull, continues. |
